Ohio Regulator Remains Operators of New Sports Betting Ads Rules

The Ohio Control Commission warned sportsbook operators for not following the new sports betting ads rules. The warning came a week before the state’s launch of legal sports wagering.

According to gambling news reports, bookmakers must have conspicuous responsible gaming message that does not specifically target anyone under the age of 21 while advertising sports betting. The commission has asserted, however, that some of the preliminary ads did not adhere to guidelines.

Although the commission has warned since June that failing to fulfill advertising requirements will result in administrative action, they do not intend to take such action. The commission also would not control marketing inside the sector.

In addition, to further assist stakeholders in complying with the legislation, it has updated some of the advertising material on its frequently asked questions webpage.

The commission does not review or approve commercials or promotions, nor does it mandate minimum font size or volume for responsible gaming messaging. Still, it does emphasize that the industry should be courteous and operate following the sports betting platform solutions‘ goals of responsible gambling.

The hotline number for those with gambling problems and any messages on responsible gaming must be at least as easily read and heard as the remainder of the advertisement, per the commission’s recommendations. The commission claims that some of the first advertisements were either difficult to read or lacked any message altogether.

Penn Entertainment, which accepts wagers under the Barstool Sportsbook brand name, received the warning after the commission issued a violation for a breach of advertising guidelines. The commission also announced its intention to refuse PlayUp Interactive’s application because the company knowingly accepted unlawful bets from residents of the United States. Thus, the message is to learn how to become a bookie legally.
